The Obama administration said Tuesday it would provide more information to Congress about the Fort Hood shootings but continued to defy a subpoena request for witness statements and other documents.
After days of negotiations, the Pentagon and Justice Department informed a Senate committee that they would not comply with congressional subpoenas to share investigative records from the Nov. 5 shootings at Fort Hood, Tex., which killed 13 people. The agencies said that divulging the material could jeopardize their prosecution of Army Maj. Nidal M. Hasan, the accused gunman.

It is almost May and the “murder” at Ft. Hood by a Muslim terrorist happened back on November 5th. It looks like Obama and his communist handlers (including the Pentagon) are dragging their feet. When is this coming to trial? Why is the Congress now trying to subpoena evidence and being denied such information? The Defense Department yesterday agreed to provide access to some of the documents subpoenaed by the Senate Homeland Security and Governmental Affairs Committee last week related to the November 5, 2009 Fort Hood shooting investigation, according to Fred Baker of the American Forces Press Service.
A letter sent to the committee today agrees to allow the committee access to the personnel file of Maj. Nidal Hasan’s personnel file, the Army psychiatrist charged with the shootings. Pentagon officials also agreed to allow the committee access to a restricted annex to the report stemming from the initial investigation by former Army Secretary Togo D. West Jr. and retired Navy Adm. Vern E. Clark, a former chief of naval operations, according to Baker’s report, obtained by the National Association of Chiefs of Police.
The department previously had objected to giving the committee access to these documents on the grounds that doing so could endanger Hasan’s prosecution. Hasan has been charged with 13 counts of murder and 32 counts of attempted murder.
“We believe we have made a very good-faith effort to try to find a middle ground … to satisfy their request,” Pentagon Press Secretary Geoff Morrell said yesterday.
“We are prepared to bend over backwards at least on two of the four issues that were the subject of the subpoena,” he added.
Morrell said that the department has been in “constant communication” with the committee even before last week’s Senate subpoenas.
Deputy Defense Secretary William J. Lynn III had a “lengthy” phone conversation April 23 with Sens. Joe Lieberman and Susan Collins, the chairman and ranking member of the Homeland Security and Governmental Affairs Committee, Morrell said.
The department declined, however, to provide access to its witnesses or to the investigative summaries of the event.
“We have made movement on some of the areas that we had originally objected to,” Morrell said. “But we have held the line on those that we feel could potentially jeopardize the prosecution of Major Hasan.
“That, in the judgment of the general counsel and our career prosecutors here, is a bridge too far,” he continued. “They really feel as though that could potentially jeopardize the prosecution of Major Hasan, and that’s the risk that they, and now the secretary, are not willing to take.”
Defense Secretary Robert M. Gates had directed the department to be as accommodating to the committee as possible without potentially jeopardizing Hasan’s prosecution. Gates recently denied hiding any documents from the committee.
“We have no interest in hiding anything,” Gates said while on a recent trip to South America.
“We will cooperate with the committee in every way with that single caveat — that whatever we provide does not impact the prosecution. That is the only thing in which we have an interest,” he said. “Our priority is in ensuring we don’t do anything that would potentially impact the prosecution of Major Hasan.”
Morrell said the committee will not be allowed to keep the documents, but will have the chance to review them. This comes even as the Army’s review is still under way, he said, and the documents contain “highly sensitive material” involving the careers of several military personnel.

Which part of “Subpoena” do they not understand?! And as far as jeopardizing the careers of top military brass, they seem to have no problem with destroying the careers of Patriots such as Lakin and Walt Fitzpatrick! Obama is obviously protecting his muslim “bro”; I thought it was peculiar when the White House demanded all the evidence regarding the Fort Hood Massacre (and then buried it). The arrogance and treasonous behavior of this administration is appalling! I pray fervently for the day when this whole squirming pile of maggots goes down in flames! All of us accused Obama for lying to the American People. I think, for the first time in his life, he told the truth. Nidal Hasan was a participant in the PROCEEDINGS REPORT OF THE HSPI PRESIDENTIAL TRANSITION TASK FORCE April 2008-January 2009.
Among the findings and recommendations read: “The President should: *employ a strategy that amplifies voices within the Muslim world that seek to counter radicalization and recruitment, and that exercises care regarding the use of lexicon;”
I now believe the radicalization and recruitment they refer to is our TEA party movement.

I saw video of one of those meetings where Hasan was in the Audience while Soetoro was speaking. It makes me wonder if there might be some embarrassing other video or emails, etc…
that will link Hasan directly to Soetoro. Nothing surprises me anymore about this Criminal that inhabits our precious White House. Godspeed.

According to the article, “Hasan faces an Article 32 hearing as early as July 1. After that, a military judge will determine whether there is enough evidence to go to trail.”

Barbara, in the Uniform Code of Military Justice Book it says that treason is punishable by death, be it hanging or firing squad, until dead! At least that was the punishment at one time. Hopefully it hasn’t changed!

I think he should be shot be a firing squad, he had no reason to kill 13 soldiers and 1 unborn baby, he is as trashy as Obama and I think a firing squad should do it for the 13 fellow soldiers. I still think the off duty soldiers should be armed,I saw a picture of several Israel female soldiers and they all had rifles over their shoulders, I bet no one messes with them.
