Grand Jury Forms and Etiquette
April 2nd, 2009
Grand Jury forms are not that complicated. Of course there must be an original document that the Presentment is written on. You should have a questionnaire form for prospective jurors. I would suggest you have a form for each juror to sign as they accept office, preferably with the oath included. There is also a form declaring eligibility. Other forms may be used as necessary, but in general these are the basics.
Presentment Form
Here are some general guidelines that an Presentment Form must follow:
REQUISITES OF AN PRESENTMENT: The Presentment shall be deemed sufficient if it has the following requisites:
1. It shall commence, In the Name of DISTRICT COURT of STATE of ___________________
2. It must appear that the same was presented where the grand jury is in session.
3. It must appear to be the act of a proper grand jury.
4. It must contain the name of the accused, or state that his name is unknown and give a reasonably accurate description of him.
5. It must show that the place where the offense was committed.
6. The time mentioned must be some date anterior to the presentment of the indictment, and not so remote that the prosecution of the offense is barred by limitation.
7. The offense must be set forth in plain and intelligible words.
8. The indictment should conclude accused violates such Criminal Codes, if known (Title __, Section _______, United States Code)
Juror Questionnaire
Some juridictions get carried away with these forms. I have seen some that are 6 to 7 pages long requiring much information. However, it is not necessary to record all this information about a prospective juror.
We don’t use a questionnaire form here at American Grand Jury. We don’t like the invasion of privacy aspect. As long as the person is eligibile and accepts the Oath you are good to go.
Oath of Office
This is the general procedure. A Clerk of the Court swears in the Jury Forman. The Jury Forman in return swears in the Jurors. Where you don’t have a Clerk involved then an Oath of Office or Affidavit form is the suggested solution. The Forman can recite the oath in front of a Notary Public and the Notary can then attest by Notary seal and signature that the Forman has legally recited and signed the Affidavit for the Oath of Office. It is a good idea for each Juror to recite and sign an Affidavit for Oath of Office. This may be overkill but it is one way to avoid legal problems regarding the swearing in of the jurors.

Statement of Eligibility
Grand Jury participants must meet general requirements of eligibility such as legal age, US citizenship, sufficient knowledge of the English language, possession of natural faculties, sound judgement and fair character, not convicted of a crime, not serving as elected public officer, not serving as trial juror in another court.
The Eligibility form is combined with our Oath of Office
Grand Jury Etiquette
This may sound funny to some, but being a Grand Juror is an important responsibility. Appropriate behavior is important. A few suggestions for etiquette are as follows:
Dress like you care. Showing up in shorts or flip flops doesn’t make a good impression with the other jurors. It is not proper in a courtroom or the jury hearing room to wear a hat, read a newspaper, eat or chew gum and of course, smoke.
You must leave children and relatives at home. ONLY sworn Grand Jurorists and designated support people are allowed in the hearing room. Remember, this is a secretive meeting that requires the upmost respect and discretion.
There is a Federal Grand Juror handbook put out by the United States Government. It is very informative and interesting.
CAUTION: This handbook is written with the Government in mind and it gives credence to the idea that a Federal Prosecutor plays a major role in the Grand Jury investigation. That is not always the case. Remember, it is the people of the United States under the Bill of Rights that are charged with performing the duties of a Grand Jury, not the Federal Prosecutor. So when you see the words “Federal Prosecutor” in the handbook you can sit there and

There are lots of Grand Juries starting up around the Country. I have not heard about one yet in Massachusetts. If I do I will be sure and let you know.
This may be of interest to you. American Grand Jury (the website you posted on) is hosting a NATIONAL ONLINE GRAND JURY. I am completing the announcement now and should be posting in the next 24 hours. This would be a great opportunity for people like yourself. It will be a HISTORIC event I think. Ditto to Annie’s post. I too am interested in organizing North Carolina and ate the info on your site for breakfast. We are having a tea party the 15th and it is my intention to set up a “table” with info on the 5th amendment. I will be seeking addresses etc of those interested in this option of seeking justice. Do not want to make any mistakes. Are there things I cannot say when gathering this list of contacts? Is this the place to start? Any advice appreciated. I am not lawyer so slightly intimidated by my lack of knowledge. I am looking to be hooked up to any and all NC citizens interested in this process…especially those with knowledge of legal system. You mentioned Grand Jurist cannot be convicted of a crime. Please expand on this. Traffic violation? Shoplifting? Felony? etc. etc.

John, a Grand Jury does not prosecute a case, ONLY hand down presentments or an indictment. The Grand Jury is only applicable to criminal cases or people that commit felonies (high crimes). You would not use a Grand Jury in the situtaion involving a misdemeanor such as shoplifting, traffic violation, etc.
Once an indictment is handed down (written accusation against the defendant) then it is the Prosecutor’s job to prosecute the case in public court. That is one of the reasons a Grand Jury hearing is conducted in secrecy, to protect the “integrity” of the indictment (to keep information secret until trial) and to protect the identity of the Jurors who indicted the criminal.

Requirements to Become a Grand Juror. National Grand Juror candidates must meet all of the following qualifications:
1- Be a natural born citizen of the United States (born in one of the fifty states of the United States to parents both of whom were U.S Citizens and resident in the United States at that time).
2- Be at least 18 years old.
3- Be a resident of the state that the Juror represents for at least one year immediately prior to selection.
4- Exhibit intelligence, sound judgment, and good character.
5- Cannot have been convicted of malfeasance in office, any felony or other high crime.
6- Cannot be serving as a public official.

You asked a question about being qualifed if you commited a crime? I believe each State may have different rules about this. In California their form states:
Now, I don’t have an intrepretation from an Attorney on this, so my thoughts are this: The online American Grand Jury will require that a “Statement of Eligibility” be signed and the criminal question will be asked. I would most certainly refuse to allow a felon or person who committed a crime serving in a public office on this jury. Regarding the misdemeanor I will try and find out if an attorney can offer some advice. If in fact a person actually went to jail because of a misdemeanor crime it may affect my decision to allow that person to participate. In the mean time I would accept the application to volunteer as an “alternate” juror until I can actually get an opinion from an attorney regarding misdemeanors. It just may be that ANY convicted crime will disqualify.
Now, with regard to what was quoted in French’s comment above:
I believe that may be incorrect. The California form only says:
I think “natural born” is the only Constitutional requirement for the President. I don’t think it applies to any other situation.
You can see in just this example how important the “natural born” issue really is.

It wouldn’t make sense, since Senators and Congressmen do not have to be natural born citizens… just citizens. The “natural born citizen” clause was made for POTUS only to prevent dual loyalties.

N my State U can do a criminal background check 4 $29 w/ consent from person checked on. I suggest all potential Grand Jury members be required to sign a consent form and pay $29.
Said requirement may disqualify certain Chicago Politicians since apparently the City of Chicago requires that all Politicians be criminals of the highest crimes and felonies.

Signing a consent form 4 Background Check would also disqualify certain politicians currently residing N Washington DC but I don’t think you want 25 Barack Huessin Obamas on your Grand Jury anyway.

Send evidence of crimes committed by BO’s campaign N UR State 2 Bob. It is important 2 indict BO in as many Cities outside of Washington DC as possible.
Otherwise, BO’s lawyers will move to have all criminal cases consolidated and get BO tried in DC. Remember the case of DC Mayor Marion Barry? The Prosecutors had videos of Mayor Barry buying and snorting crack cocaine and the DC Jury acquitted Mayor Barry.
And no doubt you all remember the murder trial of OJ Simpson in LA? As per the 5th Amendment, once acquitted a defendant can not be tried again for the same offense.
BO’s campaign committed crimes of identity theft, credit card fraud, and voter fraud in States across the US in 2008. We need all of that evidence compiled where BO cannot access it.

FYI To All: His legal name is Barry Soetoro, adopted son of Lolo Soetoro. His assumed name is Barack Hussein Obama. He has been using his assumed name for many years. His name was legally changed from Barack Hussein Obama to Barry Soetoro when he was 5 o r 6 years of ago through adoption. He was sworn in as an IL Senator,US Senator,and now President under an assumed name. No legal records have been found to show that he legally changed his name back to Barack Hussein Obama from Barry Soetoro. If there was no legal name change, then he has perjured himself. This would mean his Swearing In, under an assumed name rather than his legal name would be inull and void.

We will soon start putting the evidence together in a well organized format so all the Jurists will be able to review the information. This evidence will all be shown behind “closed” doors but that doesn’t stop anyone from submitting evidence in advance or even at the preliminary hearing.

If you would like to become a National jury member on American Grand Jury you can take the presentments (indictment) and file it yourself in your area. For those who are skiptical of the power of the Grand Jury to operate independent of the prosecutor or indeed target a prosecutor. Take a look at this little tid bit:
Because grand juries are generally composed of ordinary citizens with no special training or experience in the law, they usually follow the lead of the prosecutor assigned to them. The classic complaint of defendants’ attorneys is that grand jurors would indict a ham sandwich if the prosecutor asked them to. But they don’t always do as the prosecutor wishes, as Jeannene Pacific, the district attorney in Jones County, Mississippi, discovered. Ms. Pacific became the target of her own grand jury when it sought to investigate over $35,000 paid by the county’s Worthless Check Unit to Pacific and her staff as “salary supplements.” Alarmed, Pacific asked the local court to forbid the grand jury’s actions. Although the local court did so, the Mississippi Supreme Court ruled that the grand jury had the power to investigate:
“The grand jury must be free to pursue its investigations unhindered by external influence or supervision so long as it does not trench on the legitimate rights of any witness called before it. The court generally cannot limit the grand jury, its legitimate investigation, interfere with its investigatory function, control the nature of its investigation, prohibit consideration of offenses within any particular class of crimes, stay its proceedings, dismiss a matter, or do various other things.”
Ms. Pacific and her assistant eventually repaid over $30,000.

I am retired-so have time, I am very upset over what is happening to our country-so I am motivated, I have a modicum of education-so I am not stupid, I have collected some info.-DVD’S and reports and other info.
I have just started looking at Grand Juries and what they might do-so I am not really educated on these, but I am studying.
I do not know what your agenda would be for this, but if it involves getting Obama-or whoever he is-away from wrecking our country, I AM FOR IT!

There was the formal, televised swearing in with the ‘mistake’ by Supreme Court Justice Roberts, using the name BO; however, later that same evening at the White House there was a very private re-do of the swearing in, no bible, no robe for SCJ… and we do not know what name was used. Bob I would like to conduct one of these in Southern CA. The last box on how to file with courts is a dead link. Are there some templates available to make the paper work easier, as in ones previously used. Idea, there is a radio show that is very interested in the cause. Would it be great to hold it at the time of one of their broad casts? They would plug it for a couple weeks before we did it. They are syndicated and this would really get the word out. Your thought Bob?

I would like to know exactly what is involved. I work fulltime, a student, member of Akron/Canton 9-12ers, and leader for The National 9-12 Project. So, I have a pretty full plate. This is why I would like to investigate time constraints.

I have a question,,now that ACORN has definately been indicted for FRAUD in the state of Nevada and given that Obama actually gave them I believe the ‘amount of money ‘was in the MILLIONS’,,does this not ‘indeed’ show his involvement with this corrupt group and help our case here????

This is wonderful! We finally have a tool we can use that we can access when we need it, instead of when congress decides to listen.
Heck I’m for getting rid everyone that has committed crimes against the United States and her Constitution and her people. I know for a fact they have been stealing the people’s money, homes, sanity, and general quality of life with their continual regulations, causing panic, creating disinformation, confusion, conspiring in secret to commit treason, embezzlement, taking away our rights and the very heritage which was left us by our ancestors. They give no thgought for the millions of men and women that have literally put their lives on the line for our freedom. They have made a mockery and polluted our constitution so that it has worked against us instead of for us and corrupt judges have colluded with them to overthrow our country and make our laws of none effect. They have embarrased us before the whole world, and caused our neighbors and other nations to despise us rather than be with us. They have transgressed against the people, and committed fraud and made a mockery of our democratic voting system. I doubt very seriously that if the true votes were know George Bush would not have ever been president of this country and JFK Jr. would still be allive and 9-11 would have not happened. Iraq War would have not been. Bush used his power as the President to carry out a personal vendetta, that is why we had the war with Iraq. He put the American People and our country in jeporady and killed thousands in the war and during the travesty of 9-11. He is a liar and traitor and should be tried for his crimes against this country and the other countries he ran over because he could.
We need to take our country back and restore our integrity with the rest of the world.

I have to agree with French Canadian; remember President George W. Bush responded to the attack of our country on 9/11. Get a grip on reality, Obama is the threat to the US. I believe he is a “sleeper” that has finally made his move. He and all of his appointees need to be removed. After all, they were appointed by means of his fraudulent deception of the American people which allowed him to be elected president even though he wasn’t eligible.

I am from the People’s Democratic Socialist Republic of New Jersey. I am a very involved patriot and challenge the government on a number of levels starting with the gender discrimination of the family and criminal courts in my state. I am a constitutional law & family law paralegal.
I am interested in starting a grand jury in NJ. Based on my extensive research of grand juries, I found that they were once the controlling aspect of the entire state government and were very involved in controlling the budgets of the counties and controlling judicial and political corruption.
Since 1946, the prosecutors (across the nation; based on the Rules of Fed. Civil Procedure) usurped the authority of the grand juries and took them over as their “play-toy”. And, since 1946 state budgets have been sliding out-of-control and criminal activities of judges and politicians have run rampant.
Hence, I am interested in bringing grand juries back to the people of NJ, and need a bit of direction to get them started in this socialist state.

On my website is a link that provides an copy of my Fed complaint demanding enforcement of my statutory right to present evidence of Fed crimes to a grand jury (Section 1504). The US Attorneys Office opposed me and the fed Courts covered for them, because even Judges aren’t free from being criminally investigated!
NJ killed our right for this same reason , hence the Fed action. Everyone should demand our rightful access to State and Fed grand juries,

G.W. Bush was an excellent President. People need to stop and remember who was in Congress and Senate - same jokers that are in now. GW is a believer and he tried to always do the right thing and make the right choices. More military personell died during Clinton admin than during the Bush administration. Bush defended the lives of the unborn, Obama wants to make lab-projects out of those gifts from God. Clinton pardoned one of the terrorists from prison that flew one of the planes on 9-11.
Debra - go read for yourself, find out the truth and get ALL the facts. I think you will be amazed at the differnce between what you can learn on your own and what the liberal media spews.

I pay no attention whatsoever to the liberal media. I won’t even watch the stations. I only watch Fox and it is usually on all day and evening. At least we get the truth there. I think this current Admin is blatantly violating our beloved Constitution. I also think we can do something about it. I attend Tea Parties and can’t wait until July 4. I love George Bush and think he did a fantastic job after 9/11. I am tired of Obama blaming Bush for everything and I want it to stop. I think Obama now OWNS everything that has been done by this current admin.

If a Grand Jury is convened. Can we not compel testimony of under oath in a public forum of the people in Hawaii who fabricated the fake birth certificate. Can we do so publicly?
Incidentally, rather than trying to prove Obama was not born in the USA, why is no one trying to find evidence that he was in fact born in Kenya. Surely a dollar would go a long way in loosening tongues of his relatives, nurses, doctors, and hospital administrators.
And…if these people have already been paid off, that same dollar and publicity would incent the local gendarmes to investigate the conspiracy.

In answer to Charlene G - Hello Charlene, I am in Colorado Springs and am a member of both the Colorado Resistance and the national one. I am considering attempting to organize a grand jury in Colorado. I have found that Colorado is not mentioned yet in the American Grand Jury website. Also, I was shocked to see the limited involvement of members when I last checked the Colorado Resistance site. Where are everyone???? Any info?

This is a wonderful tool and should be used. For all that haven’t had the privilege to attend law school and grasp a real understanding of the discipline, this gives us other folks an opportunity to express disgust or the tendency to vomit when looking at, watching or hearing some of our “elected officials”. A faint opportunity that your voice may be heard under the complete control and corruption of our “leaders” that have never lost sight of the fact that looking out for themselves and their own “well being” is far more important than the lower tax payers and working poor. At 59, I can only feel like “The Bird Man Of Alcatraz”, even though I wasn’t charged with killing two men. I still have a brain and feelings, though they may try to control all else. Thoughts of the Old West comes to mind with the long scaffolds with multiple ropes hanging, waiting for justice to be served, while the people stand in awe to see the lever be pulled to release the trap doors. Our Government has been taken over by some of the greediest, selfish, self serving people that the American People have ever witnessed. We are moving backwards at record speed in almost all areas and few people seem to be looking, while these criminals line their pockets on Pork Barrel and Treasury spending sprees. I am looking forward to serving on the Grand Jury. Justice must be served as the blood of Military and Civilian Americans that died for our freedom is being diluted by an administration that will stop at nothing till their agenda is reached. It is out of control and America is slipping toward a third world status with uncontrolled spending, massive job losses, moral and political corruption, crime, abuse of authority and power at all levels. Continuing to pretend that “everything is OK” only shows the disease of apathy and self-centered fools that have grown at record levels. Greed and corruption are rewarded. Our culture and quality of life will be reserved for only the wealthiest and most corrupt that are willing “to play the game” with those in “power”. Corporate and “team player” mentality has raised it’s ugly head and is overtaking our freedoms at every corner. Union power is on a full power roll. I am Christian, a Navy Veteran and I am sick to my stomach at what I see in the Capitol and heart of our country. Ethical business people, artists and intellects are becoming scarce since they are not “considered” “team players”, no reward for them. This has gone on for years and is coming to a pinnacle since all the hogs seem to be feeding at the trough at record numbers. Our Colleges and Military are the only thing left with any honor or discipline. The left wing will stop at nothing. I hope that the Grand Jury will have an effect. I don’t think most people realize or really care about what is happening now and all the people that empowered this administration have to be just like them. A country divided will not last and it’s at fever pitch. I pray that God will intercede before it’s too late. I feel sorry for the next generation of children that will have to live in an artificial, pretentious world of artificial celebrities, politicians and leaders that will make a career of misleading, distorting, lying and misusing power at every opportunity to serve their own pleasures and whim with no regard for the public they are supposed to serve. It looks just like what we have in there now. How they picked a Chicago Pimp and a criminal administration over a Navy Pilot, Decorated War Hero, a leader from a family of Admirals with years of experience in Congress is hard to comprehend. Sometimes you have to drop down to a real low level to understand the people that are doing these self appointments at all levels. They are the types that always reach goals by default. They are the ones that can also be removed from corruption by the people, as always has been done in America’s past. Where’s the Birth Certificate, Article 2, section 1? The “Democratic Trojan Horse” must go, our country’s history is at stake and on trial.

We don’t talk much around here.. we sign up for a Grand Jury and learn how to be proactive. You need to go to the message center and get the Oath of Office filled out and returned..

is anything being done about what’s going on over the years.
we’ve been losing our country slowly for years.
people of other religions come into this country and fill our schools and take jobs such as management of homeowner associations. and tell us too many kids in our schools that don’t observe our holidays and we can’t say god in the pledge.they told our kids when they went through school we only have 1 holiday,int’l culture day at thanksgiving time ,where each kid brings thier favorite dish from thier country.excuse me here but explain to me again what country are these kids living in.it’s america RIGHT,SO DOESN’T THAT MAKE AMERICA THIER COUNTRY.AND THESE SAME PEOPLE WHO ALSO DO’NT OBSERVE BIRTHDAYS HAVE THE SCHOOLS TELLING OURR KIDS THEY CAN’T SING HAPPY BIRTHDAY AND THESE NON-OBSERVERS OF OUR GOD AND OUR HOLIDAYS BRING THIER HORRIBLE RELIGION HERE THAT ALLOWS THEM TO BLAME THIER OWN CHILDREN FOR THE CRIMES PERPETRATED AGAINST THEM AND SAY THEY DISRESPECT THIER FAMILY AND THEREFORE THEY MUST KILL THIER CHILDREN.IT’S CALLED “HONOR-KILLING” WE MUST TAKE BACK OUR AMERICA AND CLEANS IT OF THIS GREAT SIN!

I’m a former US Army, Alabama National Guard, Vietnam Era Veteran. Also former volunteer fireman/medic, Town Councilman, Alabama Real Estate Broker and Registered Land Surveyor.
I’m not so concerned about President Obama being Muslim as I am that he deceived so many about this and other questions. There is so much buzz. I’ve been following OathKeepers.org some and recommend the viewing of this. We are organizing state chapters so the chain of command for local participation may become accomplished. A step at a time and start at the beginning, as an organized march, focus on the destination. I/we need to get in line! TeaParties and other meaningful groups, leaders need common goals and co-operative communications. The People are stronger than the government, there are more of us if we can just get organized.
