Arizona Law Would Criminalize Undocumented Immigrants

PHOENIX, AZ–Arizona could become the first state in the country to criminalize undocumented immigrants.
A bill moving fast through the Arizona Senate would allow local police to arrest and incarcerate someone for “trespassing” into the territory of the state.
“The federal government is not doing its job so we’re going to do it,” said Sen. Russell Pearce (R-Mesa), author of the bill, which is called the Support Our Law Enforcement and Safe Neighborhood Act.
On Wednesday, the Senate Public Safety and Human Services Committee approved SB 1070. Pearce said he is confident that the bill would clear the Legislature and have the support of Gov. Jan Brewer.
During her State of the State speech, the Republican governor mentioned specifically that she would be working with Pearce to “enhance the existing penalties for any criminal alien who returns to our state.”
The trespassing bill would make it a misdemeanor to be in the state illegally. A person arrested twice under the law would be charged with a felony. The Arizona bill includes a number of provisions, including one proscribing “sanctuary polices,” and restricting any government agency or city from limiting immigration enforcement.
Similar bills have been unsuccessful in the past. Another version of this law didn’t get sufficient votes during the past Legislative session. In 2006, former governor Janet Napolitano vetoed it and said in a letter that this was an unfunded mandate for local law-enforcement.
This time around a new provision in the bill is drawing the attention of religious leaders. It would impose penalties on those who transport, harbor or conceal undocumented immigrants. It also would punish those who encourage an undocumented immigrant to move into the state with a misdemeanor and a $1,000 fine.
Rev. Liana Rowe of the Shadow Rock United Church of Christ in Phoenix said she is concerned that it would criminalize anyone who works with migrant communities regardless of their immigration status.
“The feds have not done anything about immigration reform. They’ve allowed the status quo to remain,” she said. “And it really allows states to go rogue on these issues, to not have a systematic and sensible and human approach.”
Over the last five years, the Arizona Legislature has been at the forefront of approving bills aimed at regulating illegal immigration. In 2005, it passed a human smuggling law that has been used to prosecute immigrants who hire a smuggler to cross the border. Three years ago, the Legislature approved one of the toughest employer-sanctions laws in the nation, which penalizes companies that knowingly hire undocumented labor.
At the end of 2009, the Legislature enacted a new law requiring state and public employees to report to immigration authorities any undocumented immigrants who apply for public benefits.
“Arizona is obviously leading in the arena of combating illegal immigration,” said Barnett Lotstein, a special assistant to the Maricopa County attorney, “and the reason for that is that we are a focal point for illegal immigration.”

This could backfire. An illegal could become a repeat offender in order to get US prison perks, ie. three squares, free medical care, color TV, air conditioning, etc. It’s a better life than what they left. US recidivism is around 75%. They better build in some safeguards. Send ‘em to Sheriff Joe! He’ll know what to do with ‘em.

The Maricopa County Attorney has baffled himself with his own b.s. by referring to ILLEGAL aliens as ‘Undocumented’ aliens.
Put simply, they have already broken the law by entering the country illegally.
We have a federal government run by people like Janet Incompetano who have violated their oath to uphold the Constitution and laws of the United States by refusing to enforce immigration laws. Fortunately, at least one state is willing to try to protect its borders.

I wonder if this will involve profiling? You know those whiny ass liberal Democrats will have a cow if that happens.
Then there could be safe international flights in and out of Arizona, because profiling would restrict the movements of would-be suicide bombers.

It’s time the States regain the “States Rights’ they were given by the Constitution! How bad has it gotten?
Our career congress ignores the million of aliens sneaking into the United States because they want their votes! IT’S ALL ABOUT VOTES! Your congressman cares more about his re-election than about your safety and quality of life. They say “Only the federal agents can enforce immigration law”. Isn’t that like saying: “You don’t want ILLEGAL aliens in your State? Tough. Live with it”!
You bet we have “States Rights”, and it’s long-overdue! Let our State Troopers, Sheriffs, and local Police enforce our immigration laws!

They say give your freedom away to get security… we will protect you from all this “evil”. They force on you ID cards, thumb’s prints, Body Scanners, etc… but they leave your borders open and unchecked… lol
It is clear that they don’t give a damn about your security… they are power freaks; all they want is to controll you and for you to become their slaves. Don’t let them do it. Don’t believe a word they say, they will stage anything to get you scared and to obey to them. Be smarter than them… educate yourself, read documents, watch documentaries, listen to Radio’s shows where they expose them: knowledge will defeat these evil creeps.

Sorry everyone get me started here I think if we layed down the law and stuck to it we would have way less problems here,for example-Child Molesters,rapists and killers-You can’t tell me If there was a straight up death penalty for those convicted beyond a doubt,that they would’nt think twice before doing such a heinous crime.Make since??

Yes, just shoot them, if they break our law one time, they will break other laws many times. Course there are good and bad in every ethnic background, but it seems to me the illegals are in every thing, Muslim, Mexicans, Caucasians, Italians, Swiss, Chinese, Japanese, Germans, French, all have their good and bad citizens, but to start off in a new country by breaking a law is only the beginning. There should be a special for San Francisco where Pelosi holds sway, she breaks law all the time, her liquor bill, her wanting abortions, yet brags about her grandkids, she is a person I don’t want to know ever. But I will close with God Bless America, soon!!!!!!!
